JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 The petitioners seek regular bail in connection with Bisfi P.S. Case No. 194 of 2019, registered for offences punishable under Sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code.

Allegation against the petitioner is that they along with other accused persons were trying to construct the temple on the land of informant but when the informant protested, he was assaulted by the accused persons and when others came, they were also assaulted by the accused persons.

It has been submitted on behalf of the petitioners that there is case and counter case between the parties with respect to construction of temple. Moreover, injuries sustained by the

Patna High Court CR. MISC. No.69334 of 2019(2) dt.10-12-2019 2/2 injured were found simple in nature and petitioners have been in custody since 10.07.2019 and chargesheet has been submitted. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Benipatti, Madhubani, in connection with Bisfi P.S. Case No. 194 of 2019, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
