JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-12-2019 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 341, 323, 307, 364, 365, 504/34 of the Indian Penal Code.

The accusation against the petitioners is that they assaulted the informant by fist and slap and also took the informant's son and confined him in a room where petitioners badly assaulted the informant's son.

The Annexure 3 to the petition goes to show that no

Patna High Court CR. MISC. No.69517 of 2019(2) dt.04-12-2019 2/2 external mark of injury, except bodyache and shoulder pain, was found on the person of the informant's son. There appears to be land dispute between the parties and both the parties appears to be agnate.

No doubt, learned counsel of the informant points out that the victim in his statement recorded under Section 164 of Code of Criminal Procedure supported the prosecution story and after institution of the present case one another case was registered against the petitioner when petitioner attacked the police party but considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No. 286/2019.
