Petitioners apprehend their arrest in connection with Madhepura (Parmanandpur O.P.) P.S. Case No.624 of 2022, registered for the offences punishable under Sections 147, 341, 323, 324, 448, 307, 504 and 506 of the Indian Penal Code. The petitioners alongwith other co-accused persons are said to have come to the house of the informant variously armed with lathi, danda and spade and assaulted the informant, his wife, son and daughter-in-law.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the

Patna High Court CR. MISC. No.72332 of 2022(2) dt.21-03-2023 2/2 present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that no specific overt act is alleged against the petitioners rather the allegation against the petitioners is general and omnibus. It is also submitted that the specific allegation of assault is against Sanjay Yadav, Dashrath Kumar, Mukesh Kumar and Lal Bihari Kumar.

The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioners. Considering the fact that no specific overt act is alleged against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura in connection with Madhepura (Parmanandpur O.P.)
