JUSTICE ANIL KUMAR SINHA ORAL ORDER 07-11-2019 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Siswan (Chainpur O.P.) Police Station Case No. 124 of 2019, disclosing offences under Sections 341/323/307/ 324/504/506/34 of the Indian Penal Code.

The allegation against the petitioner is that the petitioner assaulted the informant by means of knife, causing him injuries.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case and the dispute between the parties had arisen due to the fact that the informant and others had come to the departmental store of the petitioner and had demanded two-litres bottle of cold drinks and

No.65402 of 2019(2) dt.07-11-2019 2/3 when the petitioner demanded the money from the informant and others, they started assaulting the petitioner also, for which the petitioner has lodged Siswan (Chainpur O.P.) Police Station Case No. 123 of 2019 against the informant and others for an incident which allegedly took place on the same day. He, referring to Annexure-4, submits that the petitioner has also got injuries. He next submits that the petitioner is a bright student and is pursuing Polytechnic Engineering (Mechanical). Having regard to the submissions made on behalf of the parties and taking into consideration the fact that there is case and counter case between the parties, both the parties have received injuries and the petitioner is pursuing Polytechnic Engineering (Mechanical) course, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, Sugiriv Yadav @ Sugriv Kumar Yadav, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Siwan, in connection with Siswan (Chainpur O.P.) Police Station Case No. 124 of 2019, subject to
