2. The petitioner apprehends his arrest in a case registered for the offence under Sections 115(2), 126(2), 318(4), 316(2), 324(4), 352 and 3(5) of the B.N.S.

3. As per the prosecution case, the complainant and his wife were old aged and incapable of taking care of them, as they have no child. It was decided that accused persons would take care of them and after their death, their property would be given to accused persons. It is alleged that co-accused persons including this petitioner fraudulently sold the land of the complainant during his lifetime.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.71358 of 2025(2) dt.09-10-2025 2/2 petitioner is only deed writer to the sale-deed, which was executed by other co-accused persons. Petitioner is neither seller, purchaser nor beneficiary of the sale deed in question. Moreover, the dispute involved in this case is purely of civil nature. Petitioner claims clean antecedent.

5 . Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts, clean antecedent of petitioner and other circumstances of the case, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I Benipur, Darbhanga in connection with Complaint Case being C.R. Case No. 269 of 2024, subject to condition as laid down under Section Section 482(2) of the B.N.S.S. 2023.
