JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Piro P.S. Case No. 412 of 2018 registered for the offences punishable under Section 379 of the Indian Penal Code and Sections 4/5 of Explosive Substance Act. As per prosecution case there is recovery of huge quantity of explosive substance from the house of one Rakesh Kumar and it is alleged that petitioner is one of his associates. Submission of learned counsel for the petitioner is that except that he is an associate of main accused there is absolutely nothing against him and he has no criminal antecedent.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on
Patna High Court CR. MISC. No.65425 of 2019(3) dt.09-01-2020 2/2 furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Piro P.S. Case No. 412 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that he has to appear before police and co-operate in the investigation, otherwise his bail bonds shall be cancelled.
