JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 This application has been filed for cancellation of bail granted to opposite party no. 2 vide order dated 19.08.2019 passed in Cr. Misc. No. 18924 of 2019.

It appears from perusal of the record that after report of the learned Mediator that dispute has been resolved between the parties on payment of Rs. Ten Lakhs out of which, first installment of Rs. Three Lakhs Fifty Thousand was to be paid at the time of filing of petition under Section 13(B) of Hindu Marriage Act within one month by way of bank draft.

It has been submitted by learned counsel for petitioner that he has gone for signing the petition under Section 13(B) of

Patna High Court CR. MISC. No.70783 of 2019(2) dt.05-02-2020 2/2 Hindu Marriage Act, but she was threatened and not allowed to sign on the petition.

On the other hand, learned counsel appearing on behalf of opposite party no. 2 submitted that he has already filed a petition before the court below and a cheque of Rs. Three Lakhs Fifty Thousand were produced, on that he was directed to keep cheque and petition on the record. Further submission is that he is still ready to pay the same unless the opposite party no. 2 is ready to sign the petition under Section 13(B) of Hindu Marriage Act. Considering the submission as made above, I am not inclined to interfere with the order dated 19.08.2019 passed in Cr. Misc. No. 18924 of 2019. However, it is still open to the petitioner to appear before the Court on 24.02.2019 and opposite party no. 2 shall also appear on that date and produce the cheque and if the petitioner is ready to proceed to settled the dispute as per report of the mediator, the cheque will be handed over to her. With the aforesaid observation, this application is disposed of.
