JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Naugachia Nadi P. S. case no. 19/2018 registered under sections 406, 409, 420 of the IPC and section 3 of the Prevention of Damage to Public Properties Act.

Petitioner happens to be a contractor and he agreed to execute work as per contract entered between him as well as the concerned authority but accusation against the petitioner is that he violated terms and conditions of the aforesaid agreement. Moreover, it is informed that the petitioner had deposited security money and it is submitted that if the petitioner had

Moreover, up till now, no amount has been paid to the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Naugachia in Naugachia Nadi P. S. case no. 19/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
