JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Special case no. 195A/2017 arising out of Patna Junction P. S. case no. 621/2017 registered under sections 8, 10 and 22 of the NDPS Act.

Police recovered 68.120 kg ganja beneath seat of a train and one Arvind Kumar Rai was caught on the spot. The aforesaid apprehended accused disclosed that the petitioner no.1 fled away seeing the police party whereas petitioner no.2 was also involved in smuggling of ganja.

Submission on behalf of the petitioners is that neither

Patna High Court Cr.Misc. No.63848 of 2018(2) dt.12-12-2018 2/2 petitioners were caught at the spot nor anything was recovered from their conscious possession. Furthermore, it is submitted that the petitioners do not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum- Special Judge, Patna in Special case no. 195A/2017 arising out of Patna Junction P. S. case no. 621/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
