JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Ghorasahan PS case no. 280 of 2017 registered for the offences punishable under Section 25(1-b)a of Arms Act. The case of the prosecution is that police has got secret information that some miscreants were coming from village Bakulia to Ghorasahan hence, the police party reached the place of occurrence and apprehended the motorcycle on which the petitioner was sitting and when he tried to flee away, he was caught and one countrymade pistol was recovered from his possession.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case, has a clean antecedent and he is in custody since 08.06.2017.

Patna High Court Cr.Misc. No.53490 of 2017 (2) dt.09-11-2017 2/2 Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail immediately upon completion of six months in custody. Accordingly, the petitioner is directed to be released on regular bail immediately upon completion of six months from 08.06.2017 subject to such other conditions as may be imposed by the learned trial court.
