The petitioner is apprehending his arrest in connection with Kutumba PS Case No.93/19 registered for offences punishable under Sections 341, 342, 448, 376, 511, 323, 324 of the Indian Penal Code.

As per the FIR, allegation against the petitioner is that he tried to commit rape upon the informant and further he attacked by blade causing several injury on her chest. Submission of the learned counsel for the petitioner is that they are neighbour, falsely been implicated in this case and even statement of the girl has not been recorded under Section 164 Cr.P.C. Now the matter has been settled between the parties.

Heard learned A.P.P. , who has opposed the prayer for bail

Patna High Court CR. MISC. No.70178 of 2019(2) dt.15-11-2019 2/2 on the ground that the case is very serious in nature as such he does not deserve privilege of anticipatory bail.. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner. With the aforesaid direction, this application is dismissed.
