JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-12-2017 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in connection with Hathouri P.S. Case No. 99 of 2017 dated 21.06.2017 instituted for the offence under Section 366 of the Indian Penal Code. The petitioner is not named in the FIR. His name transpired later when it was learnt that the victim girl was forcibly married to the petitioner.

The father of the victim girl lodged a case alleging that one Meena Devi had taken his daughter while going for treatment but his daughter never returned. It only later transpired that the victim girl was abducted at the instance of 2-3 persons and was forcibly made to marry the petitioner. From the records of the

Patna High Court Cr.Misc. No.54245 of 2017 (3) dt.22-12-2017 case, it appears that though initially the marriage was forced upon the victim lady but now she is agreeable to the aforesaid relationship and wishes to continue with the matrimonial obligations. The victim girl was kept in the house of the petitioner for some time. Though in the statement recorded under Section 164 Cr.P.C. of the victim girl, there is an allegation of torture during the period that she stayed with the petitioner but such allegations do not appear to be correct for the reasons that now even the father of the victim girl, who is the informant of this case, has accepted the marriage and has shown his inclination for compounding the case.

The petitioner is in custody since 24.08.2017. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SubJudge 10th-cum-Additional Chief Judicial Magistrate, Muzaffarpur in connection with Hathouri P.S. Case No. 99 of 2017.
