1. The record reveals that initially the Writ petition was dismissed for default on 01.09.2023 and M.J.C. No. 585 of 2024 was filed and vide order dated 09.08.2024 this Court restored the Writ petition on its original file. Inspite of it, there was no representation on behalf of the petitioner thrice and this Court having no other option again dismissed the Writ petition for default.
2. Heard the Learned counsel for the petitioner
3. The averments in the restoration petition disclose that the advocate clerk could not maintain or mark the case on 28.10.2024 and
Patna High Court MJC No.3432 of 2025(2) dt.14-11-2025 2/2 25.11.2024 which resulted in dismissal for default of the case and further, the petitioner is ready to comply with any condition passed by this Court for the purpose of restoration.
4. Taking into consideration the petitioner's right is involved in the case, this Court allows the M.J.C. in order to restore the original writ petition on to its file with a condition, the petitioner shall pay a cost of Rs. 250/- to High Court Legal Services Committee, Patna High Court, Patna on or before 21.11.2025.
