JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 31-10-2018 Learned counsel for the petitioner has informed this Court that even prior to filing of the writ application the confiscation proceeding had already culminated by passing a final order.

Learned counsel submits that the petitioner instead of pressing this application, at this stage, is willing to file an appropriate application in the pending confiscation appeal before the competent authority for release of the vehicle in question.

In the aforesaid view of the matter, this application is being disposed off with a direction to the appellate authority that

Patna High Court Cr. WJC No.2489 of 2017(2) dt.31-10-2018 2/2 in case such an application seeking release of the vehicle is filed within a period of 30 days from today, the same shall be considered and disposed off by the appellate authority within a maximum period of thirty days thereafter.
