The petitioner has renewed his prayer for grant of regular bail in a case registered under sections 30(a) and 45 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 16 litres of liquor was recovered from the motorcycle of the petitioner and the petitioner was taken into custody.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 15.4.2022 (Annexure-1) passed in Cr. Misc. no. 3529 of 2022 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner is in custody since 20.11.2021.

No.72140 of 2022(2) dt.21-12-2022 2/2 Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order dated 15.4.2022 together with the petitioner having remained in custody for over 1 year, the petitioner is directed to be enlarged on bail in connection with Bagaha P.S. Case no. 612 of 2021 (Tr. no. 2773 of 2022) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Bagaha, West Champaran.
