Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Majhauliya P.S. Case No. 586 of 2022, lodged under Sections 447, 448, 341, 323, 337, 427, 354B, 316, 109, 34 of the Indian Penal Code.

As per prosecution case, the accused persons including the present petitioner have visited at the house of informant and started breaking the articles at the informant's house, upon oppose the petitioner had assaulted the wife of informant, in result miscarriage took place.

Learned counsel for the petitioner submits that age of

Patna High Court CR. MISC. No.71813 of 2022(2) dt.25-03-2023 2/2 petitioner is about 73 years. He further submits that one case is pending against the petitioner, in which, he is on bail. He also submits that petitioner is in custody since 12.08.2022. Learned counsel for the State opposes the prayer for bail.

Upon specific query that whether charge has been framed or not, learned counsel submits that charge has not been framed.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present.

Liberty is hereby granted to the petitioner that he may renew his prayer for bail after framing of charge. With this observation, the bail application stands rejected.
