The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 379/34 of the Indian Penal Code.

The prosecution case as per the Md. Ayaz dated 20.01.2018 submitted to the Station House Officer of Jokihat Police Station is to the effect that on 17.01.2018 from the office of the Panchayat Mukhiya, some unknown persons were stealing the battery of the tractor, when the driver of the informant identified the petitioner and co-accused Jabir. It is alleged that during investigation co-accused Pappu has named the petitioner in his confessional statement. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.67952 of 2018(2) dt.14-12-2018 2/2 that for the occurrence of 17/18.01.2018, the FIR has been registered on 20.01.2017 and a statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the petitioner is named in the FIR.

Considering the delayed lodging of the F.I.R. coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 18 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
