JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code The statement of the victim has been recorded under section 164 of the Cr.P.C in which she specifically stated that she left the house of her parents by her own sweet will and subsequently, she went to Jammu along with co-accused Md. Matin with whom she solemnized her marriage. The victim disclosed her age as 20 years though the learned Magistrate has assessed her age as 16 years. However, the impugned order of

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that the victim had not uttered even a single word against the petitioners, let petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Beldour P.S. Case No. 117 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
