JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Rajepur P.S. Case No. 10 of 2018, dated 16.01.2018, instituted for the offences under Sections 363 and 366(A)/34 of the Indian Penal Code.
The minor daughter of the informant is said to have been abducted by the petitioner and his parents for the purposes of marrying her. During the course of investigation, the victim girl was recovered, who has stated that her age is 19 years. In her statement recorded under Section 164 Cr.P.C., she has stated that because of the illtreatment given to her by her father, she ran away from the
Patna High Court Cr.Misc. No.66725 of 2018(2) dt.17-12-2018 2/2 house and went to Muzaffarpur, where she called the petitioner and married with him in a temple. Ever since, she has been residing with the petitioner as his legally weeded wife.
Considering the aforesaid facts as also the statement of the victim girl stating her age to be 19 years, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran in connection with Rajepur P.S. Case No. 10 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
