JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 This is an application for grant of anticipatory bail in connection with Sugauli P. S. Case No. 360 of 2018, disclosing offence under Section 304 of the Indian Penal Code. As per F.I.R. the informant has taken her two daughters in the mela and kept her near the balloon shop of the petitioner and after sometime, the cylinder of filling the balloon blasted, due to which, daughters of the informant received injuries. Later on, they scummed injuries.

Submission of the learned counsel for the petitioner is that on the basis of the F.I.R. at the best, it is the case of 304 IPC and moreover, the petitioner has also received injuries in the cylinder blast.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.64299 of 2019(3) dt.27-11-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Motihari, in connection with Sugauli P. S. Case No. 360 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
