The petitioner apprehends his arrest in a case registered for the offence punishable u/s 279, 337, 338, 307, 353, 427, 504, 34 of the IPC.

Allegedly, a Maruti car bearing Reg. No.BR01FZ-2358 was parked negligently, which was interrupting the traffic, for which the informant instructed the driver to move the vehicle from there, upon which, the driver took his vehicle and came speedily in order to crush the informant and a constable. The constable Pinki Kumari fell down and her rifle was crushed. The driver of the car fled away, hurling abuses. The informant took photo of the vehicle from his mobile camera.

It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.79677 of 2023(2) dt.05-01-2024 2/2 petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to grudge. No such occurrence, in the manner as alleged, has ever taken place. It is submitted that the petitioner is an Ex-Army man and he has not committed any offence. No person was injured in the alleged occurrence. Petitioner has no criminal antecedent. 5.

Learned APP for the State opposed the prayer for bail. 6.

Having regard to the facts and circumstances of the case, since nobody sustained any injury, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Kopa P.S. Case No.159 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
