20-11-2017 Heard Mrs. Rashmi Jha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 13-09-2017, has prayed for grant of bail in Adapur P.S. Case No. 259 of 2017 registered for offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. Learned counsel for the petitioner, at the very outset, has drawn my attention to statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent. She further submits that petitioner has falsely been apprehended on an accusation, as if petitioner, after noticing the police party, threw a bag containing huge quantity of Nepali liquor and started to flee away and thereafter, he was apprehended.

No.55419 of 2017(2) dt.20-11-2017 2/2 However, according to learned counsel for the petitioner, the said recovered articles was having no connection with the petitioner and petitioner was falsely arrested in the present case. Be that as it may, considering the nature of accusation, period of custody and clean antecedent, let the petitioner namely Hari Manjhi be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge cum Special Judge, Excise, East Champaran, Motihari in connection with Adapur P.S.
