JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-12-2019 The petitioner seeks regular bail in connection with Bihariganj P.S. Case No. 136 of 2019, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation is of snatching of motorcycle of the informant on the point of pistol.
It has been submitted on behalf of the petitioner that he is not named in the F.I.R., he has been made accused in this case on the basis of confessional statement of co-accused and except that there is nothing against the petitioner and he has been in judicial custody for more than seven months. Learned counsel for the State opposed the prayer for bail and submitted that apart from the confessional statement

Having heard both sides, considering the facts and circumstances, this application is allowed, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Udakishuganj, Madhepura in connection with Bihariganj P.S. Case No. 136 of 2019, subject to the condition that petitioner has to appear before the Officer-inCharge of the police station of his area in the second week of each month for a period of nine months so that the police may watch his conduct during that period, failing which, the prosecution shall move for cancellation of bail bond of the petitioner.
