2. The petitioner has preferred this application for grant of regular bail in connection with Khagaria P.S. Case No. 210 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 109(1), 303(2), 352, 351(2), 324, 329 read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the petitioner and other co-accused persons are alleged to have entered the house of the informant and started assaulting her. On being rescued by the informant's husband, the petitioner assaulted him by hammer due to which he sustained severe head injury and blood started oozing out, thereafter, the co-accused Amit Kumar broken the
Patna High Court CR. MISC. No.71984 of 2025(2) dt.10-11-2025 2/3 hand of the informant's husband. It is further alleged that the petitioner took away the gold worth Rs. 1,50,000/-, cash of Rs. 20,000/- and Silver worth of Rs. 10,000/- from her house.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that both the parties belong to the same village and two years ago the informant's side abducted the daughter of the petitioner but after some time the daughter of the petitioner came back and the matter was pacified with the help of the panchayati and retaliation to the said incident, the informant has maliciously lodged the present FIR. It is further submitted that the FIR has been lodged after delay of eight days without giving any plausible reason to the same. The petitioner has clean criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.07.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.71984 of 2025(2) dt.10-11-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Khagaria, in connection with Khagaria P.S. Case No. 210 of 2025, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
