Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code and Section 13(1)(c)(d) read with Section 13(2) of the Prevention of Corruption Act.

The informant was urinating by the side of the road. The police party caught the collar of the informant from behind. When the informant wanted to know his wrong, the police party abused and snatched his money. Subsequently, the money was refunded at the police station. The petitioner was one of the members of the police party.

Submission is that the petitioner has got no criminal antecedent and has falsely been implicated for the reason

Patna High Court Cr.Misc. No.58289 of 2017 (2) dt.12-12-2017 2/2 that the informant was asked not to urinate on the public place. Learned counsel for the Vigilance Bureau opposed the prayer for bail.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gandhi Maidan Police Station Case No. 451 of 2017 (Special Case No. 234 of 2017), subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
