JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 This is an application for grant of anticipatory bail in connection with Harnaut (Kalyan Bigha) P. S. Case No. 319 of 2019, disclosing offences under Sections 302, 201 and 120B of IPC.

As per F.I.R. daughter of the informant has gone with the petitioner, but later on she has found dead. It is alleged that her husband Nandu Tanti has illicit relationship with the petitioner and in conspiracy with other accused persons, they killed the deceased.

Submission of the learned counsel for the petitioner is that except suspicion, there is nothing against the petitioner, except allegation that she has illicit relationship with Nandu Tanti and she was found absconding.

Heard learned A.P.P. as well as learned counsel for the

Patna High Court CR. MISC. No.65430 of 2019(3) dt.10-12-2019 2/2 informant also, who has opposed the prayer for anticipatory bail.

Having heard both sides, as the postmortem report shows that she died due to strangulation, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, she will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Nalanda, Biharsharif, in connection with Harnaut (Katyan Bigha) P. S. Case No. 319 of 2019,, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to co-operate in the investigation and appear before the police as and when required.
