The petitioner seeks bail in G.O. case No. 542/2019, Kewati P.S. case No. 83/2019, registered u/s 30(a), 38(1), 41(1) of the Bihar Prohibition & Excise Act.

The gist of the allegation is that informant received information that petitioner was unloading liquor from a truck and on such the informant and other police officers went to the place of occurrence in order to verify the information and found many persons fleeing away after seeing the police. The learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner. The informant named the petitioner on the basis of unverified information. Patna High Court CR. MISC. No.77407 of 2019(4) dt.17-03-2020 2/2 criminal antecedent but in all other cases the petitioner has been enlarged on bail. In the present case the petitioner is in custody since 17.08.2019. The petitioner has remained in jail for about seven months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Darbhanga in connection with G.O. case No. 542/2019, Kewati P.S. case No. 83/2019.
