Versus
The State of Bihar ... ... Opposite Party ====================================================== Appearance :
For the Petitioner/s :
Mr. Md. Ataul Haque, Adv.
For the Opposite Party/s :
Mr. None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2018 Heard Mr. Md. Ataul Haque, learned counsel for the petitioner. None appeared on behalf of the State. The sole petitioner, apprehending his arrest in Jagdishpur P.S. Case No. 260 of 2018 registered for offence under Sections 376 and 511 of the Indian Penal Code, has prayed for grant of bail, in the event of his arrest or surrender. Learned counsel for the petitioner, by way of referring to annexure-2 to the petition, submits that from the petitioner's side also, F.I.R. has been lodged. He submits that petitioner is Assistant Teacher of the school, whereas informant of the present case is head mistress of the said school. He further submits that earlier, the petitioner had filed representation for his transfer, since he was not satisfied with attitude of the informant.
Patna High Court Cr.Misc. No.71874 of 2018(2) dt.04-12-2018 2/2 However, on going through F.I.R., in which there is specific accusation against the petitioner that he finding the head mistress alone in the school, tried to outrage her modesty, I do not find that it is a fit case for grant of anticipatory bail. The anticipatory bail petition stands dismissed. (Rakesh Kumar, J.) nawalkrs/- U T
