The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 406, 420 and 34 of the Indian Penal Code pending in the learned court below.
As per the allegation, the petitioner-accused has committed breach of trust and cheated the informant and grabbed worth of Rs.15,00,000/- Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that the petitioner is agreed to pay the amount worth of Rs. 7,50,000/- to the informant within six months in three installments. He further submits that petitioner have got no criminal antecedent as stated in para-3 of the bail

Learned APP for the State opposes for prayer for bail. Considering the aforesaid facts and circumstances, let the petitioner, named above, in the event of his arrest/surrender before the learned court below within a period of six weeks from today, be released on provisional bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Ghorasahan P.S. Case No.67/2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. Learned Court below is directed to confirm the bail bond of the petitioner after verifying the fact that he has paid Rs. 7,50,000/- to the informant within a period of six months in three equal installments.
Learned counsel for the informant has also given undertaking that if the aforesaid amount will be paid to the informant, the informant will withdraw all the cases lodged against the petitioner.
