====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-12-2018 Heard Sri Alok Kumar Alok, learned counsel, assisted by Sri Hans Lal Kumar, learned counsel for the petitioner and Sri D.N. Tiwary, learned Additional Public Prosecutor.
The sole petitioner, apprehending his arrest in connection with Complaint Case No. 101-C/2017, Tr. No. 272 of 2018 for the offence under Sections 406, 420 & 504 of the Indian Penal Code, 1860 has prayed for grant of bail in event of his arrest or surrender.
It was submitted by learned counsel for the petitioner that in a business dispute colour of criminal offence was given
Patna High Court Cr.Misc. No.72165 of 2018(3) dt.12-12-2018 2/2 and complaint petition was filed and petitioner has been arrayed as accused.
Beside hearing, I have perused the material available on record particularly complaint petition. Considering the nature of accusation and clean antecedent of the petitioner which fact has been stated in paragraph 3 of the petition, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner / Shambhu Kumar be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran / concerned court in connection with Complaint Case No. 101-C / 2017, Tr. No. 272 of 2018 subject to the conditions as contemplated under Section 438 (2) of the Code of Criminal Procedure, 1973.
