The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/307/504/34 of the Indian Penal Code.
The prosecution case got initiated on the Fardbeyan of Jayanti Devi, recorded by A.S.I., Rajeev Ranjan Singh, Town P.S., Begusarai, on 25.08.2018 at 7.00 A.M. at General Ward of Brain and Spinal Center to the effect that the accused persons being the agnate of the informant, including the petitioner and her husband started abusing the informant. When the informant protested, then the petitioner caught hold of the informant and
Patna High Court Cr.Misc. No.70902 of 2018(2) dt.18-12-2018 2/3 instigated her husband Bumbam Singh to kill her. Co-accused, Bumbum Singh assaulted with an iron khanti on the head of the informant causing grievous injury.
It is further submitted by learned counsel for the petitioner that the thrust of accusation is against co-accused, Bumbum Singh, the husband of the petitioner, while the petitioner is a lady and due to property dispute the accusation has been levelled. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent. It is submitted by learned APP for the State that the petitioner is named in the FIR with specific accusation. Considering the fact that the thrust of accusation is against co-accused, Bumbum Singh, the husband of the petitioner and the petitioner is a lady, coupled with statement made in paragraph no.
3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Manjhaul, Begusarai, in connection with Cheriya Bariyarpur (Manjhaul O.P.) P.S.
