JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2018 Heard the parties. This is the 3rd attempt made by the petitioner for grant of bail.

Earlier, prayer of bail of the petitioner was rejected on merit vide order dated 18.5.2017 passed in Cr. Misc. no. 6568 of 2017.

Learned counsel for the petitioner submits that the petitioner is in custody about 19 months and the charge has been framed against the accused persons and the case was fixed for evidence on 31.01.2018.

From perusal of the report, it appears that the trial will be concluded within a period of six months from the date of

Patna High Court Cr.Misc. No.58059 of 2017 (5) dt.07-02-2018 2/2 receipt/production of a copy of this order and at the same time, the Superintendent of Police, West Champaran, Bettiah with a direction to ensure that the witnesses/accused were present in court on the date fixed so that the trial may be concluded within a period of fixed date.

The aforesaid direction must be complied in strict sense.

With the aforesaid observation, this application is dismissed.
