This is an application for grant of anticipatory bail in connection with Mahua PS case no. 160 of 2017 registered for the offences punishable under Sections 341, 323, 324, 307, 447, 379, 504/34 of Indian Penal Code.
The allegation is regarding the accused persons including the petitioner herein having assaulted the informant and his family members.
The learned counsel for the petitioners submits that the fact is that altercation had taken place in between the prosecution side and the accused persons resulting in both sides having received injuries. Infact the petitioner no. 2 had also been grievously injured. It is further submitted that the case filed by the petitioner is first in the series of cases filed by both parties, inasmuch as the same bears Mahua PS case no. 159 of 2017 dated 20.06.2017 whereas the present case is Mahua PS case no. 160 of 2017 dated 20.06.2017. It
Patna High Court Cr.Misc. No.906 of 2018 (7) dt.04-07-2018 is further submitted that the petitioner no. 1 is having a clean antecedent while the petitioner no. 2 is accused in one case, in which he is on bail.
Having regard to the facts and circumstances of the case, the abovenamed petitioners, in the event of their arrest or surrender before the court below within a period of six weeks from the date of receipt/ production of a copy of this order, are directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua PS case no. 160 of 2017 subject to the conditions as laid down under Section 438(2) of Code of Criminal Procedure.
It is further directed that the petitioners shall mark their presence before the officer-in-charge of the concerned police station at 10 am on every Monday and in case of failure to do so on two consecutive occasions, the present privilege of bail shall stand cancelled automatically.
