Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.
The petitioner seeks regular bail in connection with Kateya P.S. Case No. 252 of 2020, lodged under Sections 302, 201(B)/34 of the Indian Penal Code.
As per prosecution case, the F.I.R. has been lodged against five named accused persons, in which, allegation has been made by the informant that she has raised suspicion against the named accused persons that they have brutally assaulted her husband and got him admitted in Gopalganj hospital. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further
Patna High Court CR. MISC. No.71698 of 2022(2) dt.25-03-2023 2/2 submits that petitioner has been made accused in this case only and only by virtue of family members and husband of one of sister of informant. He also submits that vide Annexure-3 series all named accused persons have been granted bail. Learned counsel further submits that antecedent of petitioner is clean and he is in custody since 30.08.2022.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Learned Chief Judicial Magistrate, Gopalganj in connection with Kateya P.S. Case No. 252 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.
With this observation, the bail application stands allowed.
