Mr. Lokesh, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 10-01-2025 Heard Mr. Sabal Kumar Jha, learned counsel for the petitioner and Dr. Arvind Kumar, learned C.G.C. for the Narcotics Control Bureau.
2. The petitioner seeks bail, who is in custody since 23.03.2022, in connection with N.C.B. Case No. 02 of 2022 arising out of N.D.P.S. Case No. 60 of 2022, for the offences punishable under Sections 8(c), 21(c), 22(c) and 29 of the N.D.P.S. Act.
3. Earlier the prayer for bail of the petitioner was rejected by this Court vide order dated 11.04.2023 passed in Cr. Misc. No. 57615 of 2022. Thereafter, the petitioner has filed Special Leave to Appeal (Cr.) No. (S) 12285 of 2023 before the
Patna High Court CR. MISC. No.75847 of 2024(4) dt.10-01-2025 2/3 Hon'ble Apex Court which was dismissed on 29.04.2024.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the FIR and the petitioner has not committed any offence as alleged in the FIR. The petitioner is rotting in judicial custody since 23.03.2022.

Learned APP for the N.C.B. vehemently opposed the prayer for bail of the petitioner and submits that total 2 kg of Alprazolam has been recovered from the bag of the Jay Prakash Singh who stated that before the officers of the N.C.B. that the petitioner has sent him to Sasaram on 16.01.2022 to purchase and bring 2 kg of Alprazolam from Deepak Kumar of Sasaram and CDR also supports that the petitioner was also involved in the present crime in question and apart from that the petitioner carries four cases other than the present one out of which two cases pertains to the N.D.P.S. case.
6. Vide order dated 06.12.2024, a report with regard to the present status of the trial was called for. Report of the learned Trial Court dated 11.12.2024 reveals that out of six witnesses, four witnesses have been examined and two prosecution witnesses are yet to be examined.

7. Considering the facts and circumstances of the case as well as the report of the trial Court, I am not inclined to enlarge the petitioner on bail in connection with N.C.B. Case No. 02 of 2022 arising out of N.D.P.S. Case No. 60 of 2022 pending in the Court of Additional District and Sessions JudgeX, Bhojpur, Ara.
8. Prayer is refused.
9. However the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) ajay/- U T
