JUSTICE SANDEEP KUMAR ORAL ORDER 04-03-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Hathauri P.S. Case No. 67 of 2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 323, 325, 302, 307, 504, 506 of the Indian Penal Code.
The petitioners are in custody since 08.09.2022. The petitioners are the agnates of the deceased. Similarly situated co-accused Suman Kumar has been granted bail by a co-ordinate Bench of this Court vide order dated 31.08.2022 passed in Cr. Misc. No. 44276 of 2022. For the reasons mentioned in the order dated
Patna High Court CR. MISC. No.72321 of 2022(2) dt.04-03-2023 2/2 31.08.2022 passed in Cr. Miscellaneous No. 44276 of 2022, this application is allowed.
Let the petitioners, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Rosera, Samastipur, in connection with Hathauri P.S. Case No. 67 of 2022.
This is also subject to the condition that (i) the petitioners would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioners and (ii) petitioners will mark his presence in Hathauri Police Station, District- Samastipur on first Sunday of every month, failing which his bail bond shall be cancelled by the court below.
