JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 This application, for grant of anticipatory bail, arises out of Sadar P.S. Case No. 500 of 2019, disclosing offences under Sections 420, 406, 506, 504/34 of the Indian Penal Code. Allegation as per F.I.R. is that petitioner and other accused persons were running Jalashay Thrift and Credit Self Supporting Cooperative Society Limited and they said to have taken deposits from the different persons including informant and after collecting money, they fled away and not returning the amount of informant and others.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, as there is no allegation against the petitioner that money was handed over to him rather money was handed over to other accused persons of

Further submission is that similarly situated coaccused has been granted the privilege of anticipatory bail vide order dated 22.10.2019 passed in Cr. Misc. No. 64188 of 2019, as he was also employee of the said company.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 500 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is with further subject to the condition that petitioner shall cooperate in investigation and make himself available as and when required.
