JUSTICE SANJAY PRIYA ORAL ORDER 23-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Turkauliya (Banjariya) P.S. Case No. 06 of 2017 instituted for the offence under Sections-147, 148, 341, 323, 324, 307, 379, 504 of the Indian Penal Code. As per written report, there is specific allegation against the petitioner of assaulting the informant with Farsa causing serious head injury, thereafter, blood started oozing and he fell down. Case diary has been received in which Injury report is enclosed. Doctor has found injury no. 1 on the left parietal region of scalp, which is grievous in nature, caused by hard and blunt substance. Counsel for the petitioner has further submitted that doctor has given another injury report which is enclosed as Annexure-2 but in the case diary, only one injury has been mentioned at para-30 of the case diary.
Considering the nature of injury, I am not inclined to
Patna High Court Cr.Misc. No.59650 of 2017 (3) dt.23-01-2017 2/2 grant anticipatory bail to the petitioner and as such, his such prayer stands rejected in connection with Turkauliya (Banjariya) P.S.
