2. Petitioner seeks regular bail in a case registered for the offence punishable under Sections 30(a) of the Bihar Prohibition & Excise (Amendment ) Act 2022 . 3 . As per the prosecution case , 80 litres of spirit and 4000 empty bottle of 300 ml were recovered from road side .

4. Learned counsel for the petitioner submits that recovery has been made from an open place . No incriminating material has been recovered from conscious possession of the petitioner. Petitioner is in custody since 09.09.2024 . Chargesheet has already been submitted.

5 . Learned A.P.P. for the State vehemently opposed

6. Considering the nature of accusation and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Court no. 2nd Aurangabad Bihar in connection with Obra P. S. Case No. 355 of 2024 .
