The petitioner is apprehending his arrest in connection with Complaint Case bearing No.1259 of 2018 registered for offences punishable under Section 498A of the Indian Penal Code.

As per the complaint petition, there is allegation against the petitioner, who happens to be husband of the informant, of demand of motorcycle and for non-fulfillment of that, the complainant was tortured. Further allegation is that he is residing with one Prity Kumari and now he has married with Prity Kumari.

On the other hand the learned counsel for the petitioner

Patna High Court CR. MISC. No.65072 of 2019(2) dt.21-10-2019 2/3 has submitted that he has not married with above girl and he is ready to file an affidavit to that extent and further he is ready to keep the informant with dignity and care.

Heard learned A.P.P. and the learned counsel for the O.P.n.2, who has opposed the prayer for but submitted that she is ready to reside with the petitioner if she is allowed to live with dignity and care and no subjected to further torture.. Having heard both sides and in view of stands of the parties, both the parties have to appear before the learned court below on1 14.11.2019 and on filing affidavit by the petitioner that he will keep her with dignity and care and will not subject her to torture and also file an affidavit that he has not married with any other lady and he is ready to take her from the court below itself, the learned court below shall release the petitioner on provisional bail in connection with Complaint Case No.

Patna High Court CR. MISC. No.65072 of 2019(2) dt.21-10-2019 3/3 deems fit an proper including cancelling the bail bond of the petitioner.

With the aforesaid direction, this application is disposed of.
