The petitioner apprehends his arrest in Sikandara P.S. Case No.160 of 2018 registered under Section 307 and other Sections of the Indian Penal Code.
The informant alleged that the petitioner had borrowed Rs.50,000/- from him. When the informant went to demand his money, the son of the petitioner and others assaulted the informant and his family members. Petitioner is alleged to have assaulted Ramu Yadav, the father of the informant with lathi which hit on his lip.
The learned counsel for the petitioner submits that there is a case and counter case being Sikandara P.S. Case No.164 of 2018. The father of the informant got simple injury on lip but on account of fracture of right index finger, the injury
Patna High Court Cr.Misc. No.74985 of 2018(2) dt.20-12-2018 2/2 is opined to be grievous. The petitioner is not an author of the injury on right index finger.
Considering the aforesaid facts and the fact that there is a case and counter case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Maneesh Kumar Pandey, learned J.M. 2nd Class, Jamui in connection with Sikandara P.S. Case No.160 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
