JUSTICE SHIVAJI PANDEY ORAL ORDER 28-08-2018 Learned counsel for the petitioner submits that the judgment dated 28.1.2016 passed in C.W.J.C. No. 7743 of 2015 (Nand Kishore Prasad & Ors. Vs. The State of Bihar & Ors.) as also the judgment dated 5.7.2017 passed in C.W.J.C. No. 189 of 2017 (Jharu Mahto & Anr. Vs. The State of Bihar & Ors.) and other analogous cases squarely cover the case of the present petitioner.

In that view of the matter, let the authority concerned should examine the fact of the present case and the case of the aforesaid cases and if it is found that the present case is squarely covered by the aforesaid cases, the same benefit should also be
