The petitioner is apprehending his arrest in connection with Barahara P.S.Case No.200/19 registered for offences punishable under Section 395 of the Indian Penal Code. As per FIR, five miscreants armed with Pistol stopped the Tractor of the informant, looted away Samsung Mobile, golden locket and Rs.6,000/- and also drove away with the Tractor. Petitioner is not named in the FIR and later on his name transpired on the confessional statement of the co-accused, who has been arrested.

Submission of the learned counsel for the petitioner is that except the confessional statement there is nothing against him and he has no criminal antecedent.

Heard learned A.P.P. who has opposed the prayer for bail

Patna High Court CR. MISC. No.65073 of 2019(2) dt.21-10-2019 2/2 on the ground that unless the petitioner appears before the police, he could not be put on TIP, which is necessary. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail With the aforesaid direction, this application is dismissed.
