2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 30 (a) and 32

(3) of the Bihar Prohibition and Excise (Amendment) Act, 2022.

3. The case of the prosecution is that altogether 820.800 liters of country made liquor was recovered from the Cabin of the 10 wheeler truck. It is further alleged that the petitioner is the driver of the truck.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the petitioner is only the driver of the said vehicle and he was not

It is further submitted that from perusal of the seizure list, it would transpire that the seizure list witnesses are police personnel. Moreover, the petitioner is languishing in judicial custody since 01.09.2025 having no criminal antecedent.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Siwan Excise P.S. Sadar Case No. 545 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. -II, Siwan.
