JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 This modification application has been filed for modification of order dated 02.08.2019 passed in Cr. Misc. No. 34220 of 2019 by which with certain conditions order has been passed in favour of the petitioner and he was directed to surrender by 13.08.2019.

Submission of learned counsel for the petitioner is that he was suffering from Jaundice due to which petitioner could not surrender in time. Learned counsel for the petitioner has also shown some medical prescriptions.

Heard learned A.P.P. also.

In such situation, I do not find any merit in the application. In spite of that taking leniency in the matter this application is disposed of with direction to the petitioner to

Patna High Court CR. MISC. No.70453 of 2019(2) dt.06-11-2019 2/2 surrender by 21.11.2019 before the learned court below, other part of the order shall remain intact.

It is made clear that no further indulgence will be granted.
