Petitioner is apprehending his arrest in connection with Singhwara PS Case No. 140/2018 for the alleged offence under Sections 341, 323, 384, 354, 379, 448, 504, 506/34 of the Indian Penal Code.

Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner and the informant are gotias. There is no specific allegation of overt act against the petitioner except that he participated in maarpit and looted valuables. Considering that petitioner and the informant are gotias and that he has no criminal antecedent, this application is allowed.

Accordingly, in the event of arrest or surrender before

Patna High Court Cr.Misc. No.74158 of 2018(2) dt.21-12-2018 2/2 the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate V, Darbhanga in connection with Singhwara PS Case No. 140/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as also on the condition that one of the bailors should be Mukhiya or Sarpanch of the local Panchayat.
