1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117, 109, 303(2), 352, 351(2) and 3(5) of the BNS, 2023.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 16.06.2025 at 02:00 PM, a panchayati with regard to dispute relating to land was in progress when accused persons including the petitioner came and assaulted his mother and brother and petitioner assaulted the informant by rod causing injury on head.

4. Learned counsel for the petitioner submits that

It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that a panchayati with regard to dispute relating to land was in progress when the occurrence is alleged to have taken place. It is further submitted that on account of dispute relating to land, an altercation had taken place in which both sides assaulted each other. It is next submitted that there is specific allegation against this petitioner of assaulting the informant Mukesh, but then the injury suffered by Mukesh has been opined to be simple in nature as recorded in the order impugned. It is also submitted that informant side got so aggressive that they assaulted the side of the petitioner and others injuring six family members and Akhilesh was admitted in AIIMS, Patna for treatment.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.71049 of 2025(2) dt.04-11-2025 3/3 each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Taraiya P.S. Case No. 187 of 2025 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application is allowed.
