2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 30 (a) and 41 (I) of the Bihar Prohibition and Excise Act.
3. The case of the prosecution is that altogether 3000 liters of spirit was recovered besides the road in 15 drums. It is also alleged that the petitioners tried to flee away but he was apprehended on the spot.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in connection with the present case. It is further submitted that nothing has been recovered from the conscious possession of the petitioners. It is further submitted that the only allegation

It is also submitted that the petitioner has been implicated in connection with the present case merely on suspicion. It is further contended that the petitioner no.1 has two criminal antecedent while the petitioner no. 2 has one criminal antecedent of similar nature. Moreover, the petitioner is languishing in judicial custody since 20.08.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Excise P.S. Case No. 317 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court NO. 2, East Champaran, Motihari, with a condition that the petitioners shall not indulge himself in similar nature of case in future.
