2. The petitioner seeks bail in connection with Agamkuan P.S. Case No. 373 of 2013 registered for the offence under Sections 364, 395 of the Indian Penal Code.

3. As per the prosecution case, one Dodha Rai and other criminals are said to have committed loot of the tractor and subsequently, the driver of another tractor namely Gauri Shankar Singh was killed.

4. The petitioner is in custody since 20.03.2025.

5. It has been submitted by the learned counsel for the petitioner that this Court may consider the period of custody of the petitioner and also consider the fact that there is no direct allegation against the petitioner and the petitioner has been implicated in this case on the basis of confessional statement of

Patna High Court CR. MISC. No.75139 of 2025(5) dt.30-03-2026 2/2 co-accused.

6. Considering the fact that this is a case of loot and murder, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application stands dismissed.

8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
