JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 Petitioner apprehends his arrest in connection with Jamalpur P.S. Case No. 66 of 2018 registered for the offences punishable under Sections 376, 511, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner is that he entered inside the house of the informant and attempted to commit rape upon her.

Submission of learned counsel for the petitioner is that impugned order itself shows that there is land dispute between the parties and petitioner was aged 18 years, whereas informant was aged 40 years at the time of occurrence and as such whole prosecution case is false and concocted. Heard learned APP also.

No.78702 of 2018(2) dt.10-01-2019 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Biraul, District Darbhanga, in connection with Jamalpur P.S. Case No. 66 of 2018, corresponding to G.R.No. 380 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
